Divorce
There is only one ground for divorce being that the marriage has broken down irretrievably. In Order to Petition for divorce you need to have been married for a year.
In Order to satisfy the Court that your marriage has broken down irretrievably you need to be able to prove one of five factors being:
- Unreasonable behaviour
- Adultery
- 2 years separation with consent
- 5 years separation without consent
- Abandonment
Expert advice should be sought to assist with completing the Court paperwork and to deal with any problems that might occur during the divorce proceedings. For example your spouse might live abroad or refuse to cooperate in the divorce proceedings.
You should be aware that although you can get divorced this does not formally dismissed the majority of financial claims you and your ex-spouse have against one another. Expert advice should be sought to ensure you are properly protected at the conclusion of the divorce proceedings.
